In New York State, when a petroleum product (> 5 gallons) has been released into subsurface soil and/or groundwater, a NYSDEC Spill case will be generated. The responsible party (RP) will be held responsible for the cleanup of the spill until the necessary cleanup and/or removal actions have been completed.

Depending on the volume of the spill and the subsurface geology, a spill case can take from days to years to remediate. The cleanup costs typically range from hundreds to hundreds of thousands of dollars. In a sense, each spill case is unique, restrained by the site conditions and the client objectives. Therefore, spill management requires both technical expertise and interaction skills with the regulatory agencies as well as the client.

When regulatory agencies lay out the remedial action objectives (RAO), it is usually non-negotiable. We respect their role as knowing WHAT needs to be done. Nevertheless, we can always negotiate HOW and WHEN the RAO should be achieved. In reality, we share the same goals with the regulatory agencies; to perform corrective activities to address the needs of the environment.

The regulatory agencies typically prefer quick and thorough remediation for the protection of the environment, regardless of the cost to the client. However, “quick” and “thorough” may not be the most cost-effective solution. On behalf of our clients, we negotiate with the regulatory agencies, based on technical feasibility and cost-effectiveness, to achieve a mutually beneficial result.

A Brownfield designation refers to sites previously used for industrial purposes or certain commercial uses. A designated parcel may be contaminated by low concentrations of hazardous waste or pollution, and has the potential to be reused once it is remediated. Redevelopment of a Brownfield site is often impeded by frustration and costly time delays as local officials and developers work to resolve elusive issues of environmental contamination.
